Succession/Estate Planning

Succession planning is often linked to the transfer/sale or inheritance of the family business. However, at Clarke & Company we also advise on succession planning for capital or wealth such as property, shares, cash or entitlement from a self-managed superannuation fund. We carefully review our clients’ estate plan to assess the taxation and future issues on the transfer of assets from the estate. This includes testamentary trusts, self-managed superannuation funds, family law issues and sibling rivalry. These matters need to be reviewed regularly in view of possible new issues arising such as family law, death of a dependent or an unexpected inheritance from another family member. Bernard McMenamin has extensive experience in this area and is a Trust and Estate Practitioner and a member of STEP (Society of Trust & Estate Practitioners).

An initial discussion with Bernard will identify any matters or issues to be addressed. He will then liaise with your Wills & Estates lawyer or you can be referred to our associate Wills and Estates legal firm, Clarke Lawyers.

Bernard also has significant experience as an executor of estates and can act independently or with other family members in this role if you are concerned about family members acting as executors creating conflict. He also acts as trustee of clients’ Charitable Foundations.
